Plain English first: We host beautiful digital wedding invitations. You pay the launch price shown in your local currency once, and we host your card with no expiry date. There is no automatic subscription. You own your content. We don't sell your data. Australian Consumer Law applies. That's the short version — the full version is below.
1. About Kadly
Kadly is operated by Irfan Rafiq trading as Kadly, ABN: 99 818 138 075, New South Wales, Australia. Kadly is a digital wedding invitation platform. You create a personalised invitation card, pay a one-time fee, and we host it at a unique public URL with no fixed expiry date.
By using Kadly, you agree to these Terms. If you do not agree, do not use the service.
2. Eligibility
- You must be at least 18 years old to create an account and make purchases.
- You must provide accurate information when creating your account.
- One account per person. Shared or automated accounts are not permitted.
- By using Kadly, you represent that you meet these requirements.
3. Your Content
Ownership
You retain rights in the invitation content you upload or create on Kadly — including names, photos, and stories. Guest personal information is not owned by either party; you may use it only as permitted by applicable law, and you instruct Kadly to process it to provide the RSVP features. You grant Kadly a limited, non-exclusive, royalty-free licence to store, process, display, and transmit your content solely for the purpose of providing our service. This licence ends when we complete deletion of your card or account, subject to legally required retention and temporary provider backup copies.
Your responsibilities
- You must have the right to use all content you upload (photos, text, names, etc.).
- You must not upload content that is illegal, defamatory, pornographic, hateful, or infringes third-party rights.
- You are responsible for the accuracy of your invitation details (date, venue, names).
- You are responsible for any legal obligations arising from inviting guests and collecting their RSVP data.
DMCA / Copyright
If you believe any content on Kadly infringes your copyright, contact us at privacy@kadly.co with: (a) a description of the copyrighted work; (b) the URL where the infringing content appears; (c) your contact details; and (d) a statement that you have a good-faith belief the use is not authorised. We will review valid notices promptly.
4. Payments & Pricing
Fees
- Launch fee: One-time payment to publish your card. Hosting has no fixed expiry date and no renewal fee.
- The exact price and currency for your market are displayed before you pay. There is no automatic renewal or subscription.
The total amount charged is displayed at Stripe Checkout. Applicable taxes are shown only where they have been configured for the transaction.
Refunds
- Launch fee: Full refund if requested within 24 hours of payment, including after publication. After 24 hours, refunds remain available where required by applicable consumer law.
Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition implied or imposed by the Australian Consumer Law (Competition and Consumer Act 2010 (Cth), Sch 2) that cannot lawfully be excluded. Where Kadly fails to meet a consumer guarantee, you are entitled to a remedy under the Australian Consumer Law.
Chargebacks
If you initiate a chargeback without first contacting us at hello@kadly.co to resolve the issue, we reserve the right to suspend your account pending investigation.
5. Hosting & Takedown
- Published cards are hosted from the date of publication with no fixed expiry date, for as long as Kadly operates the service. Cards published before August 2026 under the earlier 30-day term are also hosted on this basis.
- You can ask us to take your card offline at any time by emailing hello@kadly.co.
- We may unpublish a card that has been refunded, or that breaches the acceptable-use rules in these Terms.
- Card and RSVP data for unpublished cards are retained until no longer needed or until a valid deletion request is completed. Uploaded-image deletion is handled separately. See the Privacy Policy for the current process.
- If Kadly ever winds down or materially changes hosting for existing cards, we will give existing customers at least 30 days notice.
6. Guest Data & Privacy
When guests submit RSVPs, they provide personal information (name, email, phone, attendance, dietary requirements). For the purposes of data protection law:
- You decide why you collect and use guest RSVP data. Where those legal terms apply, you may be the data controller and Kadly may process that information on your behalf.
- You must comply with the privacy and communications laws that apply when collecting, using, or contacting your guests.
- We do not use guest data for our own marketing or share it with third parties beyond what is needed to operate the service.
See our Privacy Policy for full details.
7. Acceptable Use
You must not:
- Use Kadly for any unlawful purpose or in violation of these Terms.
- Attempt to access, scrape, reverse-engineer, or decompile any part of Kadly.
- Use Kadly to distribute spam, malware, or unsolicited communications.
- Resell, white-label, or sublicense Kadly without a written agreement with us.
- Impersonate another person or entity.
- Interfere with or disrupt the integrity or performance of Kadly.
- Create cards for fictional, fraudulent, or deceptive events.
We reserve the right to remove content or terminate accounts that violate these rules.
8. Intellectual Property
Kadly, its logo, templates, design system, software, and all related intellectual property are owned by Irfan Rafiq trading as Kadly. Nothing in these Terms grants you any right to use our brand, trademarks, or intellectual property beyond what is strictly necessary to use the service.
9. Service Availability
- We do not guarantee uninterrupted access or a particular uptime percentage.
- We may perform maintenance, which we will announce where possible.
- We are not liable for losses arising from downtime, including missed RSVPs. We recommend exporting your RSVP data regularly via the CSV download in your dashboard.
10. Limitation of Liability
To the maximum extent permitted by law (including the Australian Consumer Law), our total liability for any claim relating to Kadly is limited to the amount you paid us in the 12 months prior to the claim. We are not liable for indirect, consequential, incidental, or punitive damages.
11. Termination
- Account deletion is currently available by contacting privacy@kadly.co. We will remove associated database records and separately remove uploaded images, subject to legal retention requirements and temporary provider backup copies.
- We may suspend or terminate your account with reasonable notice if you breach these Terms.
- In cases of serious or repeated violations (e.g. illegal content, fraud), we may terminate immediately without notice.
- Refund rights under Section 4 survive termination.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Both parties submit to the exclusive jurisdiction of the courts of NSW, except where applicable consumer law requires otherwise.
Note to Malaysian and Indonesian users: Nothing in these Terms excludes your statutory rights under Malaysian law (Consumer Protection Act 1999, PDPA 2010) or Indonesian law (UU No. 8/1999, UU PDP 2022).
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of Kadly after that date constitutes acceptance of the revised Terms. We maintain a history of significant changes at the bottom of this page.
14. Entire Agreement & Severability
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Kadly regarding the service. If any provision is found unenforceable, the remaining provisions continue in full force.
